When a marriage breaks down one of the most common areas of dispute is how to deal with the matrimonial finances. The family law team at Freers Askew Bunting Solicitors, headed by Zoe Tansley, are experienced in dealing with cases that involve modest assets, as well as those where the matrimonial assets are into the millions. Matrimonial assets can include things such as the family home, cars, pensions, and cash assets. To reach a binding agreement regarding the matrimonial assets, a Financial Remedy Order will need to be made. A Financial Remedy Order sets out how the matrimonial assets are to be distributed and if the Order contains a clean break clause, then it will sever the financial ties between the parties.

An agreement regarding a couple’s finances can be reached in a number of ways; either through negotiation, mediation or by a court, but only when an agreement is put before a court and sealed does it become an Order that is legally binding in the family court. We will advise you as to the best way to achieve a Financial Remedy Order in your particular case.

When considering a Financial Remedy Order the court will consider the welfare of any child of the family under the age of 18. They will also look at the income, earning capacity and other resources available to the parties, their needs and responsibilities, standard of living, the age of the parties and the duration of the marriage, disabilities, contributions to the family, the conduct of the parties and potential financial loss.
