As of April 6, 2022, irretrievable breakdown is the sole ground for divorce. Either party or both jointly may apply. After the initial application and acknowledgement, a 20-week reflection period must pass before proceeding. Following this, couples apply for a Conditional Order confirming the breakdown. Six weeks and one day after the Conditional Order, a Final Order application concludes the divorce.

SEPARATION
Following a marriage breakdown, couples may separate without divorcing. Our experienced team advises clients on all options. Settlement agreements can outline arrangements for finances, property and children, though such agreements cannot become court orders. Courts may consider these agreements during subsequent divorce proceedings.
