Child Assessment Orders (Section 38)

How we can help

If a child is placed with a family member under s. 38(6) of the Children Act 1989, this is a specific placement where the child can be assessed by the local authority. Under this section, the child can stay with the family member or friend under an Interim Care Order for the purposes of assessment during proceedings.

If a local authority social services department are speaking to you about any of these situations, please get in touch with us, and we can see if we can assist you and whether Legal Aid will be available to fund your case. It often is available in these types of cases. This may be available even for aunts, uncles, grandparents or other family members of the child the local authority is concerned about.
