Freers Solicitors Win an Historic Victory Against the Ministry of Justice

On the 11th October 2012 judicial review proceedings brought by Freers against Ministry of Justice concluded in an order to quash a decision originally made by the now defunct Legal Services Ombudsman in September 2011.

On the 11th October 2012 judicial review proceedings brought by Freers against Ministry of Justice concluded in an order to quash a decision originally made by the now defunct Legal Services Ombudsman in September 2011. Our Mr. Richard Vaux commenced the application with the assistance of Mr. Philip Engelman of Trinity Chambers in the High Court of Justice Queen’s Bench Division Administrative Court in Leeds. The case originates from advice on title that Freers gave to clients in 2004 in respect of the purchase of a commercial lease. The Ministry of Justice was represented by the Treasury Solicitor.

His Honour Judge Langan QC granted Freers application to bring proceedings on all 7 of the grounds advanced and commented on the complexity of the case. Mr. Vaux said, “I believe Judge Langan’s decision was instrumental in demonstrating the strength of Freers case and highlighting the extent of the LSO’s errors in making its original decision.” The Ministry of Justice subsequently decided not to defend the application to a full review hearing and the final order was made by consent.
